Penalty points and disqualification

Many motoring offences carry penalty points. A driver who reaches 12 or more points within three years faces disqualification under the totting up rules. Drivers within two years of passing their test lose their licence if they reach six points.

Some offences, including drink driving, carry a disqualification on conviction regardless of the points already on a licence.

Exceptional hardship and special reasons

If a disqualification would cause exceptional hardship, to you or to people who depend on you, the court can be asked not to disqualify or to shorten the ban.

A special reasons argument is different: it asks the court not to endorse a licence or disqualify because of circumstances connected with the offence itself. Both need careful preparation and supporting evidence.

Fixed fees

Fixed fees are available for some motoring matters, including guilty pleas to drink driving and exceptional hardship hearings. Full details are on our motoring offence pricing page.

Common questions

What is a Notice of Intended Prosecution?

It is a warning that you may be prosecuted for certain motoring offences, such as speeding. For many offences it must normally reach the registered keeper within 14 days of the offence.

What is the minimum ban for drink driving?

A conviction for drink driving carries a disqualification of at least 12 months, and longer for a second offence within ten years. The court can offer a drink drive rehabilitation course which, once completed, shortens the ban.

What happens if I reach 12 points?

The court must normally disqualify you for at least six months, unless it accepts that a ban would cause exceptional hardship.
