Your right to a solicitor
Anyone questioned by the police about an offence has the right to free and independent legal advice, whether they are under arrest or attending voluntarily. You can ask for a solicitor at any time, and asking for one is not a sign of guilt.
What happens at the police station
- Disclosure: before the interview, we ask the police what evidence they have.
- Private consultation: we speak with you in private to take your account and explain the options before the interview.
- The interview: we sit in on the interview with you and can step in if questions are unfair or improper.
- Afterwards: you may be charged, released on bail, released under investigation, or released with no further action.
Voluntary interviews
A voluntary interview, sometimes called an interview under caution, carries the same weight as an interview after arrest. What you say can be used in evidence, so it is just as important to have a solicitor with you.

Do I have to pay for a solicitor at the police station?
No. Legal representation at the police station is free for everyone, whatever their income.
How long can the police hold me?
Usually up to 24 hours before they must charge or release you. In serious cases this period can be extended.
What is the difference between arrest and a voluntary interview?
At a voluntary interview you are not under arrest and are free to leave, but the interview is still conducted under caution and what you say can be used as evidence.
